● Customer must comply with the payment schedule to make and maintain a reservation of both a vehicle and a specific time slot for travel.
● The attached invoice sheet and this document constitute the entirety of all contracts and conditions.
● Rates include fuel, the motorcoach, and driver for your convenience. Customer is free to provide gratuity based on satisfaction with the service of the driver. Cash given to the driver is considered a gratuity and does not replace, reduce, or impact the charges for the reservation.
● The final quote shall be incorporated herein by reference.
● CANCELLATION POLICY: Customer may cancel their trip at any time. If the trip is cancelled prior to thirty (30) days before departure, then all payments except the deposit will be refunded. If the trip is cancelled less than thirty (30) days before departure, 100% of the trip becomes non-refundable.
● The total cost of this service will be billed at the actual time of usage of the vehicle. Unscheduled wait time (traffic/road conditions do not apply), additional services, unplanned tolls, parking fees, cleaning fees, vehicle damage, and other surcharges that cannot be calculated prior to service are not included in this reservation and will be invoiced after the trip. Inspection & garage times are for internal use only. Our drivers do not determine the length of service, nor do they end the service at the minimum requirement. BHTT reserves the right to bill the additional charges to the Customer.
● Customer is responsible for all additional costs related to their trip. These charges include, but are not limited to, customer caused damages to the vehicle, cleaning fees, parking fees, tolls, and admission and/or entrance fees for our vehicles. Customer shall be responsible, at BHTT’s sole discretion, for any damage to the vehicles caused by Customer.
● Customer is responsible for accommodating stay for our driver(s) if the trip consists of one or more overnight stays. Any overnight or multiple day trips must have the itinerary into our office for review no less than 10 business days prior to the trip date.
● Baggage and all other personal property brought onboard vehicles will be handled at the passengers’ own risk.
● Customer is responsible for any damage to the vehicle due to disorderly behavior. BHTT, in its sole discretion, reserves the right to terminate service at any time, and without notice, with no refund if any member of the group acts in a disorderly and violent manner or violates any law.
● The use of any device or substance that may produce smoke, harmful vapors, unpleasant smells including but not limited to tobacco products, incense, drug paraphernalia, is strictly prohibited in all vehicles at all times. All vehicles are NON-SMOKING and there is an automatic $500.00 charge per violation. If needed, a driver can stop to accommodate the passengers to smoke outside of the vehicle. Customer agrees to an automatic $500 cleaning fee for a violation of this anti-odors policy.
● Consumption of alcoholic beverages in BHTT vehicles is permitted, though glass containers are not. Customer may bring hard sided, non-Styrofoam coolers with non-alcoholic beverages, food, portable electronic devices, and reasonably sized carry-on luggage at no extra charge. Employees of BHTT have the right to determine what constitutes a reasonably sized carry-on item. Underage drinking is strictly prohibited on BHTT vehicles. Any illegal use of drugs in our vehicles is prohibited and the ride will be terminated, and no refund will be issued. Alcohol consumption is not permitted in the company of minors. Alcohol related or safety problems by a guest of any age may result in the termination of the reservation with no refund on the total charge. Customer agrees that BHTT is not responsible for any property damage or personal injuries to any guest whose injury is related to alcohol consumption in any way, or that relate to, or arise from, the violation of any laws, rules, or regulations.
● Customer agrees to a minimum $300.00 sanitation charge for any stains or fluids spilt resulting from illness inside our vehicles. Customer agrees to a $150.00 charge per EMERGENCY EXIT opened by Customer, or Customer’s guests. Customer also agrees to a minimum $250.00 cleaning charge for excessive trash and debris on the vehicles.
● Company is not liable in the event of mechanical breakdown and will only be responsible for making up lost time or providing alternative transportation.
● BHTT reserves the right to lease equipment from other companies in order to fulfill this agreement. BHTT cannot guarantee the assignment of requested drivers or vehicles and will not be held liable for loss of time due to traffic conditions, inclement weather, or any conditions or situations outside of BHTT’s control.
● If applicable, more than one driver may be needed to comply with US Department of Transportation Federal Motor Carrier Safety Regulations (USDOT FMCSR), part 395. These regulations limit our drivers to ten (10) hours of continuous driving time. FMCSR regulations also limit our drivers to fifteen (15) hours of working time followed by 8 hours of consecutive off-duty periods within any 24-hour timeframe.
Disclaimer of Liability. NEITHER BHTT or any of their affiliates or any of their respective officers, partners, employees, directors, members, owners, managers or agents (collectively, “BHTT”), will be liable or responsible for any loss, damage, or injury to any person or to any property of customer or customer’s employees, officers, directors, successors, assigns, agents, contractors, subcontractors, suppliers, invitees and all other persons receiving BHTT Services, resulting from any cause whatsoever, unless due to, and only to the extent of, the gross negligence or the willful misconduct of BHTT.
If paying by check, please write the invoice number on your check and ensure that the check is received by BHTT in sufficient time for compliance with the applicable booking deadlines. There is a $35.00 service fee for all returned checks. Payments may be cash, cashier’s check, money order, wire transfer or credit card (convenience fees applied to credit card payments). BHTT reserves the right to cancel any reservation, without notice, if payments are not received by due dates.
In the sole judgment of the driver, if s/he determines that the behavior of Customer, or Customer’s guests, is out of control, unsafe, illegal, dangerous, or irresponsible to lives and/or property, the driver may terminate the run and order all occupants out of the vehicle. The driver may or may not issue a warning before taking such action. If this happens, Customer shall not receive a refund.
